Soho Driving School — Terms of Service

1) Acceptance of Terms

By creating an account, booking, or making a payment, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use our services.

2) Eligibility

You must hold a valid learner’s permit and meet all DMV requirements. Minors must have a parent/guardian consent to enroll and pay.

3) Accounts & Communication

Provide accurate contact details and update them as needed. We may contact you via phone, email, or SMS regarding lessons, scheduling, and reminders. You may opt out of SMS at any time by replying STOP. Standard carrier rates may apply.

4) Scheduling & Cancellations

• Lessons: Cancel at least 24 hours in advance to avoid a $25 penalty. Late arrivals: the instructor waits up to 15 minutes; after that, the lesson may be lost or a $25 reschedule fee applies. No-shows incur a $15 penalty or lesson forfeiture.
• Road Tests: Cancel at least 12 hours in advance to avoid penalty. Road-test cars are shared (4–5 students per test day). We book on a week-by-week basis and cannot guarantee specific dates.
• Where to meet: We do not offer pick-up service. Meet at our school or, where offered, the DMV site.
• How to cancel: During business hours only — Mon–Fri 9:00 AM–6:00 PM, Sat 9:00 AM–3:00 PM. No voicemail or email cancellations. Same-day cancellations are treated as no-shows.

5) Student Responsibilities & Safety

• Bring your learner’s permit and required corrective lenses to every lesson and test.
• Wear closed-toe shoes. No sandals or flip-flops during lessons or tests.
• Follow instructor directions and all traffic laws. We may end a session for unsafe behavior without refund.

6) Payments, Refunds & Credits

• Prices, taxes, and fees are shown at checkout. Payment is due at purchase or as otherwise stated.
• Canceling an incomplete package: you will be charged for services already used plus a 10% or $20 fee (whichever is greater). Refunds are issued to the original payment method.
• Credits, deposits, packages, and gift certificates must be used within one (1) year of purchase.

7) Road Test Conditions

• At least one lesson with our instructor is required before using a school car for the test (additional fee may apply).
• Bring current, valid paperwork (permit; any required certificates) and arrive on time. We are not responsible for DMV delays, cancellations, or examiner availability.

8) Changes to Services

We may modify schedules, services, or prices at any time. If we make a significant change to a booked service, we will attempt to notify you and offer a reasonable alternative or refund for any unused portion when required by law.

9) Intellectual Property

All site content, materials, and lesson resources are owned by or licensed to Soho Driving School and protected by law. You may not copy, distribute, or exploit them without permission.

10) Disclaimer; Limitation of Liability

Training is provided “as is” and results may vary. To the fullest extent permitted by law, Soho Driving School and its instructors are not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim will not exceed the amount paid for the applicable service.

11) Indemnification

You agree to indemnify and hold Soho Driving School harmless from claims arising out of your misuse of the services, violation of these Terms, or violation of any law or third-party rights.

12) Privacy & SMS

We handle your personal information as described in our Privacy Policy. We may share limited data with trusted processors (e.g., payments, SMS) under confidentiality obligations. You can opt out of SMS by replying STOP at any time.

13) Disputes & Governing Law

These Terms are governed by the laws of the State of New York. Before filing, the parties will attempt good-faith resolution within 30 days of written notice. Either party may bring qualifying claims in New York small-claims court.

14) Termination

We may suspend or terminate services for violations of these Terms or unsafe conduct. You may stop using the services at any time; applicable refund terms in Section 6 apply.

15) Miscellaneous

• Severability: If any provision is unenforceable, the rest remain in effect.
• No Waiver: Failure to enforce a provision is not a waiver.
• Updates: We may update these Terms; continued use after posting means acceptance.
